Legal Requirements for Safety Data Sheets (SDS) and RGS Services

1. Legal Obligations

  • EU REACH Regulation: According to the EU’s REACH Regulation No. 1907/2006, as amended by Regulation 2020/878, it is mandatory to prepare a Safety Data Sheet (SDS) for hazardous products.
  • Turkish KKDIK Regulation: In Turkey, the preparation of SDS is also required under the KKDIK regulation (published on 23/06/2017, Official Gazette No. 30105) for hazardous products.


2. Amendments in KKDIK Regulation

  • Article 64 of the KKDIK regulation repealed the previous Regulation on Safety Data Sheets for Hazardous Substances and Mixtures, published in the Official Gazette No. 29204 dated 13.12.2014.
  • As of 31.12.2023, all SDSs must be prepared according to Annex II of KKDIK by a Certified Chemical Assessor (KDU).


3. Obligation to Update SDS

According to the Turkish SDS regulation, the SDS must be updated without delay if any of the following situations arise concerning a substance or mixture:

  • A structural change occurs in the chemical substance
  • New information is obtained that may impact risk management measures
  • The substance is granted or refused authorization, or restrictions are imposed


If the SDS is not updated in such cases, it will be considered invalid, as announced by the Ministry.

4. Responsibilities

  • According to Article 27 of the KKDIK Regulation, the “manufacturer” is responsible for the preparation and submission of SDSs for their own substances/mixtures.
  • “Only Representatives” may also take on the responsibility of preparing Turkish SDSs for manufacturers, subject to mutual agreement.


5. RGS Services

RGS provides SDS and extended SDS preparation services in compliance with the KKDIK regulation in Turkish and, according to the REACH Regulation, in 54 languages, through its team of experienced experts certified by accredited institutions of the Ministry of Environment, Urbanization and Climate Change. Additionally, RGS offers SDS updating and validation services.
