Regulatory Overview
Under the European Green Deal, the European Commission announced its objective to reduce carbon emissions by 55% compared to 1990 levels by 2030 and to become the first carbon-neutral continent by 2050. In line with these goals, the Carbon Border Adjustment Mechanism (CBAM) Regulation came into force on October 1, 2023, and was officially published by the EU Council on May 10, 2023.
Affected Sectors
Initially, six sectors with the highest risk of carbon leakage are covered. By 2034, all sectors under the Emissions Trading System (ETS) are expected to be included:
- Cement
- Iron and steel
- Aluminum
- Fertilizers
- Hydrogen
- Electricity
Reporting and Certification Processes
During the transition period until January 1, 2026, importers into the EU must report both direct carbon emissions from the manufacturing of the relevant products and indirect emissions from electricity used in production. As of January 1, 2026, financial obligations will increase, and notifications will need to be submitted by an "Authorized CBAM Declarant." Import operations can be conducted directly by importing companies or via indirect customs representatives.
