Responsible Person
In Article 4 (1) of the EU Cosmetics Regulation it is indicated that “Only cosmetic products for which a legal or natural person is designated within the community as ‘responsible person’ shall be placed on the market”.
The responsible person carries out many of the legal obligations of the cosmetic manufacturer or importer in regard to the regulations. The main items of these obligations are:
- To ensure compliance with the regulation
- To recall the product from the market in case of non-conformity
- To inform competent authorities when a risk is available
- To provide necessary documents and information to CA
- Traceability for 3 years
Who must be the Responsible Person?
The responsible person can be appointed for an EU or non-EU based product.The person needs to have extensive knowledge about the regulation. Furthermore, he has to provide the sources as a proof for granting all obligations.
